The internal turmoil surrounding British extreme metal veterans Cradle of Filth has exploded into a significant legal battle. Six former members of the band have joined forces to file a lawsuit against frontman Dani Filth (real name Daniel Lloyd Davey), his associated business entities, and The Oracle Management, the firm run by DevilDriver vocalist Dez Fafara.
The complaint, originally filed in the U.S. District Court for the District of Arizona on September 30, 2025, and amended on November 20, alleges a pattern of systemic exploitation, including unauthorized commercial use of likenesses, unpaid royalties, and defamation.
The coalition of plaintiffs includes recent departures Zoe Marie Federoff (keyboards/vocals) and her husband Marek “Ashok” Smerda (guitars), alongside longtime guitarist Paul Allender, former keyboardist/vocalist Lindsay Schoolcraft (listed as Lindsay Matheson), former guitarist Richard Shaw, and Sasha Baxter, a model and performer who appeared in the band’s recent music videos.
According to the court filings, the grievances paint a picture of a business operation that allegedly profited from its musicians without proper compensation or consent.
Key allegations in the suit include:
- Unauthorized Use of Likeness: Several plaintiffs claim they never signed agreements permitting the band or its management to use their names and images for commercial purposes, yet merchandise and promotional materials featuring them continue to be sold.
- Intellectual Property Theft: Schoolcraft alleges that the band has misused her original copyrighted “sigils” artwork on merchandise without authorization.
- Unpaid Wages and Royalties: The suit claims the band withheld financial accounting regarding merchandise, recording royalties, and publishing agreements. Baxter specifically alleges she was never paid for her appearances in the music videos for “Malignant Perfection” and “To Live Deliciously,” only to later discover merchandise featuring her image from those shoots being sold.
- Defamation: The complaint addresses public statements made by Dani Filth following the acrimonious exit of Federoff and Smerda in August. It alleges Filth made disparaging and false claims regarding Federoff‘s alcohol consumption and a miscarriage, causing significant reputational harm.
- Property Disputes: Federoff claims her custom microphone was destroyed and her in-ear monitors were never returned.
The legal action follows a public meltdown in late August, where Federoff and Smerda quit the band mid-tour, citing a “threatening” work environment and refusal to sign what they described as an unfair contract. At the time, Filth fired back on social media, accusing the couple of unprofessional behavior and alcohol abuse—claims the lawsuit now vigorously contests.
The plaintiffs are seeking a jury trial and demanding broad remedies, including the destruction of all infringing merchandise, compensatory and punitive damages for financial and emotional distress, and coverage of legal fees.
As of this report, neither Dani Filth nor The Oracle Management have issued a public response to the amended filing.
